6. Right of revocation
Within 14 days you may revoke your order in writing without giving a reason (also by eMail) or by returning the goods. The period starts at the earliest with the receipt of the goods and this instruction. In order to observe the revocation period, the timely returning goods or the sending of the revocation is sufficient. The revocation is to be sent to Chabali Fuerstenwall 163 40215 Duesseldorf In case of an effective revocation, the payments or goods received have be to returned by both parties. If you cannot guarantee a return of the goods received in total or if you can only guarantee it in part or only in a deteriorated state, you will have to pay compensation for the loss in value. In the case of a revocation, you as the orderer, are obligated to return the goods with sufficient postage to Chabali. If the value of the goods exceeds an amount of 40.00 Euro, the shipping charges are paid by Chabali. The value of the returned goods is refunded.
7. Retention of title
The goods delivered remain the property of Chabali up to the complete payment of the purchase price.
8. Transport damages / defects
You, as the customer, are obligated to examine the goods immediately at delivery both for damages and for obvious defects. Possible damages have to be indicated to the deliverer immediately and be noted on the shipping documents. Furthermore, defects and transport damages are to be indicated in writing to Chabali within 7 working-days after the delivery of the goods. If the supplied goods are unsatisfactory, Chabali will provide the customer with a replacement or it will reduce the price for the goods. Chabali is however justified to refuse the kind of the selected supplementary performance, if it is only possible with disproportionate costs and the other kind of supplementary performance is without substantial disadvantages for the buyer. If the supplementary performance fails, the customer can, at his discretion, demand a reduction of the purchasing price or withdraw from the contract. The warranty for defects is limited in total to a period of one year starting from receipt of the goods.
9. Miscellaneous
Only German law applies to the contractual relation between Chabali and the orderer. Personal data of the orderer is only collected in the framework of the legal provisions of the Federal Law for Data Protection (Bundesdatenschutzgesetz BDSG) and used exclusively in the context of this contract. Place of performance for all obligations from the contractual relation is Duesseldorf. For merchants and legal entities of the public law, the place of jurisdiction Duesseldorf is regarded as stipulated.
10. Final clauses
In case parts of these terms and conditions are invalid, the validity of the entire contract is not affected. The invalid part of the terms and conditions is replaced by the applicable legal provision.
